HARMON DICK’S WILL
In the name of God Amen. I
Harmon Dick of Woodberry Township, Bedford County and State of Pennsylvania
being sick and weak in body but of sound mind memory and understanding praised
be God for it and considering the certainty of death and the uncertainty of the
time thereof and to the end I may be the better prepared to leave this world
whenever it shall please God to call me hence do therefore make and declare
this my Last Will and Testament in manner following that is to say first and
principally, I commend my soul into the hands of Almighty God my creator hoping
for free pardon and remission of all my sins and to enjoy everlasting happiness
in the heavenly kingdom through Jesus Christ my Savior my body I commit to the
earth at the discretion of my executors herein after named. Item I give and
bequeath to my true and beloved wife Margaret Dick the third part of my Estate
Real and personal. Besides two horses two cows and one heiffer
and three Beds and bedsteads of which she sees proper to take one stove and
pipe one table and chest the clock and cubbert and my
will that she shall have my Plantation for own use for the space of term of
time of five years after my decease provided she remains my widow during that
time or term of years, after that time she is to have one acre and an half of
ground at the spring up in the meadow from the house she is also to have the
timber of the place to build a house and stable and also wood for fire during
her natural life and then no fire wood to be given to said house any more. It is
also my will that my executors make a free deed of conveyance to her for said
one and an half acre of ground to her forever. And after the expiration of the
five years it is my will that my Plantation shall be sold by my executors in
the best way they think it prudent, It is further my will that my executors put
the one third of the purchase money on Interest and also the one third of the
payments as they become due for the use of my widow. Item I give and bequeath
unto each of my grand children of my daughter Catharine four in number twelve
dollars unto my grand children of my daughter Elizabeth four in number each
twelve dollars, unto my grand children of my daughter Peggy one in number
twelve dollars. I further give and bequeath unto my grand children Christian
Dick and Catharine Stull each of them fifty Dollars. I further order that my
Executors make sale of all my personal property soon after my decease except no
grain shall be sold of no kind. Item I devise and bequeath all the rest and
residue of my estate both real and personal to be equally divided amony my children in equal portion share and share alike
and I make or order George B. Spang. and Harmon
Farber executors of this my last will and testament revok
and annulling all former wills, by me heretofore made ratifying and confirming
this and none other to be my last will and testament. In testimony where of I
have here unto set my hand and affixed my seal this third day of March in the
year of our Lord one thousand eight hundred and twenty five.

the probate of wills and granting letters of Administration in and for said
county Edward Cowen and Jacob Poth the subscribing
witness to the foregoing instrument of writing who being duly sworn according
to law do depose and say that they were personally present and heard and saw
the testator Harmon Dick sign and declare the foregoing instrument of writing
as and for his last will and testament that at the time thereof the testator
was of sound and disposing mind, memory and understanding according to the best
of these deponants knowledge and belief and that they
subscribed their names there as witnesses in the presence of the testator and
at his request.

This agreement made and concluded
upon the 29th day of December 1828 by and between John Paul and Mary Paul of
Conemaugh township Cambria county and State of Pennsylvania of the one part,
and Simon Dick of Woodberry township Bedford County and State aforesaid of the
other part: Witnesseth: Whereas Harman Dick late of Woodberry
township Bedford County and State aforesaid, deceased, did in his last will and
testament, did give and bequeath unto Mary Paul, wife of John Paul, who being
one of his lawful heirs a certain portion of his estate - And the said John
Paul and Mary his wife do for and in consideration of the sum of one hundred
dollars in hand paid the receipt whereof is hereby acknowledged, doth grant,
bargain and sell and forever quit claim unto the said Simon Dick, all their
right, title, claim and interest to the estate of Harman Dick, deceased, for
any sums that the said Harman Dick may have bequeathed unto Mary Paul by
marriage being a lawful heir of the said Harman Dick, deceased. In witness
whereof the said parties have hereunto set their hands and seals the day and
year first above written.

This Indenture made the
thirteenth of December in the year of our Lord one thousand eight hundred and
twenty eight; George Dick, John Dick, Samuel Dick, Daniel Dick, Simon Dick,
Jacob Dick, George Brown the husband of Julian Dick formily,
and David Brown the husband of Barbara Dick formilly,
and Mary Dick, of Bedford County State of Pennsylvania, Sons and heirs of Hermon Dick, late of Bedford County, Woodberry township and
state aforesaid of the one part, and Margret Dick, of
the same township County and State aforesaid, of the other part. Witnesseth that the said George, John, Samuel, Daniel,
Simon, Jacob Dick, George and David Brown and Mary Dick, for an in
consideration of the sum of eighteen hundred dollars lawful money of
Pennsylvania to them in hand paid by the said Margret
Dick the receipt whereof is hereby acknowledged, hath granted, bargained, sold,
released and confirmed and unto the said Margraet
Dick all their right title interests and claims of in and to a certain tract of
land situate lying and being in the township of Woodberry County and State
aforesaid, adjoining lands of Michael Bate, Edward Cowen, John Nicholas and others,
containing one hundred and twenty five acres be the same more or less - To have
and to hold the said tract of land with the appurtenances unto her the said Margret Dick, her heirs and assigns forever. And the said
George, John, Samuel, Daniel, Simon, Jacob Dick and George and David Brown and
Mary Dick, doth hereby covenant, promise, grant and agree to warrant and
forever defend the tract of land aforesaid, with the appurtenances unto the
said Margret Dick, her heirs and assigns against them
George, John, Samuel, Daniel, Simon, Jacob Dick, George and David Brown and
Mary Dick and their heirs and against all persons claiming under them. In
witness whereof the said George, John, Samuel, Daniel, Simon, Jacob Dick,
George, David Brown and Mary Dick, hath hereunto set their hands and affixed

At an Orphans Court held at
Indiana in and for the County of Indiana on the 24th day of December A.D. 1839
The Petition of Simon Dick Son and heir at law of Margret
Dick late of Green Township in said County decd setting forth That your
Petitioner's said mother lately died intestate leaving issue ten children all
of full age by Susanna intermarried with Samuel Green, George Dick, Julianna intermarried with George Brown, Barbara
intermarried with David Brown, John Dick, Samuel Dick, Daniel Dick, Simon Dick
your petitioner, Jacob Dick and Polly intermarried with Jacob Stittser and that said intestate died seized in her demesne
as of fee of in a certain piece of parcel of land situate in said Township of
Green adjoining lands of Simon Dick, John Over, Jacob Putt and James Lydick containing fifty five acres be the same more or less
with a log house and double barn and about twenty four acres cleared thereon.
Your petitioner therefore humbly prays your honors to award an inquest to make
partition of the premises aforesaid to and among the children and heirs of said
deceased in such manner and in such proportions as by the laws of this
Commonwealth is directed if such partition can be made without prejudice to or
spoiling the whole but if such partition cannot be made thereof as aforesaid
then to value and appraise the same according to law and make report of their
proceedings herein to the next Orphans Court etc. And he will pray etc.

Whereupon due consideration
had of the premises Inquest awarded by the Court and personal notice as to all
the heirs within this County and by four publications in two newspapers
published in this Borough. Writ issued January 20th 1840.
The execution of this Writ
appears by a Schedule or inquisition hereunto annexed.
So answers Wm. Evans, Sheff.
To the honorable the Judges
in the foregoing writ named I William Evans High Sheriff of the County of
Indiana Do certify that in obedience to the said writ I did on the thirteenth
day of March A.D. 1840 go upon the lands mentioned in said writ taking with me
the good and lawful men whose names are hereunto annexed, who being first duly
sworn according to law (Public notice having been first given by me to the
parties in said writ mentioned) the good and lawful men aforesaid after viewing
the premises Do upon their oaths aforesaid say that the same cannot be parted
and divided to and among the said parties without prejudice to or spoiling the
whole. They therefore value and appraise the afore mentioned fifty five acres
of land at the sum of fourteen dollars and forty three cents per acre amounting
in all the sum of seven hundred and ninety three dollars and sixty five cents.
In testimony whereof as well the said Sheriff as the said Inquest have hereunto
set their hands and seals the day and year first above written.
