MRS. R.J. BENDER, AN
OCTOGENARIAN, DIES OF PARALYSIS
Deceased Made Home Here Since
1920, When She Was Stricken at Stoyestown
FUNERAL ON SATURDAY
Mrs. Rebecca J. Bender,
aged 80 years, who was identified with one of the oldest families of Somerset
County, died at 12:45 o'clock this morning at the home of her son-in-law and
daughter, Mr. and Mrs. H.F. Zimmerman, 823 Franklin street, where she had been
residing since May, 1920, when she was stricken with paralysis at her residence
in Stoyestown. Her condition became critical about a
fortnight or so ago. Mrs. Bender was a cousin of the Thomas and Von Lunen families of this city.
The deceased was a daughter
of Mr. and Mrs. Levi Griffith and was born October 12, 1842, near Jenner Cross Roads, Somerset County. She was one of a
family of nine children, three daughters and six sons, and is the eighth of the
number to pass away. Her surviving brother is Matthew S. Griffith, of Derry.
Levi Griffith was a miller and farmer and was engaged in business at Jenner Cross Roads for a long time before establishing a
mill at Waterford. The Levi Griffith family came to Johnstown early in the '80s
and located in the Sixth Ward. Both her father and mother died in Jenner Township, her mother before the Civil War and her
father about 20 years ago.
Mrs. Bender was married
twice, the first time late in the '50s to Levi Berkey,
who served in Company I, 93d Regiment, P.V.I., during the Civil War. Mr. Berkey died on his farm in Jenner
Township, in December, 1872. To this union the following children were
born: Ella, wife of John W. Hoffman, of
326 Luzerne street, Westmont; Franklin E. Berkey, of
1480 Franklin street; Anna, wife of H.F. Zimmerman, mentioned above, and Atley L. Berkey, of 711 Franklin
street. In 1882 the deceased married John F. Bender, also a veteran of the
Civil War. He served in Company G, 93d Regiment, P.V.I., having gone out from Stoyestown under Capt. A.C. Maitland. Private Bender was
wounded at Petersburg, Va., in March, 1865, and was in an army hospital when
the company was mustered out of service in the summer of that year. John F.
Bender died in Stoyestown on April 23, 1915, at the
age of 83 years, leaving his widow and a son, the latter being F.G. Bender,
D.D.S., of 1101 Edson avenue, Eighth Ward.
Besides her brother and
sons and daughters, Mrs. Bender is survived by 14 grandchildren and nine
great-grandchildren.
Mrs. Bender has been a
member of the Methodist Episcopal Church for about 70 years. She united with
the Hopewell congregation about 1852 and later transferred her membership to
the Stoyestown charge, where she was the oldest communicant.
The funeral will take place
on Saturday from the Stoyestown church, the eulogy to
be given there by the Rev. Thomas H. Morris, pastor of Calvary M.E. Church, Morrellville. Burial will be in Odd Fellows' Cemetery. Six
grandsons of the deceased will act as pallbearers.

Lydia Griffith-
I am the widow of Edward
Griffith deceased. I live in Jenner Township. The
real estate owned by my husband was decreed to me by the court in March 1885. I
have eight minor children living-namely Carl A. Griffith, Edward F., Charles
L., Jere. J., Cora B., Robert L., Guy K., Nettie C. Wm. S. Morgan, of Jenner
Township is the guardian of all of my children. I am a daughter of Michael Kring deceased and a granddaughter of Frederick Beisecker deceased and a sister of George Kring deceased. I rec'd as one of the heirs of Fred'k Beisecker deceased
$741.24, and as one of the heirs of George Kring
deceased $480.00, and as one of the heirs of Michael Kring
deceased $1158.76 - making in all $2380.00. I gave all this money to my husband
Edward Griffith with the understanding that at his death I was to have the
farm. My money was used to buy the farm.
Levi Griffith Esq.-appd.
I am the father of Edward
R. Griffith dec'd, and am the administrator of his
estate. At different times during Edward's life he told me that he wished he
had had the farm deeded to his wife, that her money was in the farm and that
she ought to have it and that if anything happened to him he wanted her to have
the farm. I heard her testimony and know that the sum of money she says she
received went loaned by her to her husband. I saw her give him money at
different times.
To the Honorable the judges
of the Court of Common Please of Somerset County Penna.
The undersigned Auditor
appointed by said Court "to make a distribution of the personal fund and
also to fix the amount of the recognizance, widows dower and distribute the
real estate fund which was decreed to Lydia Griffith, widow of Edward R. Griffith
dec'd," respectfully report:
That after giving due
notice, by advertisement in the Somerset Herald and Somerset Democrat, of the
time and place of meeting we sat at his office in Somerset Borough on Friday
Nov. 27th 1885 and from there adjourned to the office of Fred. W. Beisecker, Esq. in the same Borough where he was attended
by Fred. W. Beisecker Esq. Atty. for Levi Griffith
Adm. of Edward R. Griffith dec'd. When the account
filed of the Administrator aforesaid and the testimony hereto attached was taken.
From the testimony taken
and records submitted it appears that Edward R. Griffith died intestate leaving
to survive him a wife and eight minor children and that his father, Levi
Griffith was duly appointed to administer upon his estate. The real estate of
said deceased was appraised at $2400.00 and was decreed by the court to the
widow. It also appears from the testimony that the deceased was indebted to the
widow Lydia Griffith, to the amount of $2380.00, for money she had loaned him.
This amount is allowed her by the auditor, and being taken from the real estate
fund obviates the necessity of fixing the recognizance and widows' dower. In
his account the Administrators charges himself with $2163.55, amount from sale
of dec'd personal property and claims credit for
$136.38 leaving a balance of $2027.25, which amount, together with the real
estate fund is distributed in the following manner:
