4          Samuel JAY, born 1 Sep 1812 in Southampton Twp. Bedford Co. PA; died 7 Sep 188314.  He married (1) Mary Ann WALTER 17 Mar 1833 in Bedford Co. PA; born 4 Jul 1815 in Southampton Twp. Bedford Co. PA; died 22 Nov 185614.  He married (2) Margaret CONRAD ca 1859; born 2 Apr 1839 in Mann Twp. Bedford Co. PA15; died 7 May 190916.

5          Christina JAY, born in Southampton Twp. Bedford Co. PA17.  She married William SMITH. [nothing further known]

6          Rosella JAY, born 16 Jul 1817 in Southampton Twp. Bedford Co. PA17,18; died 15 Feb 1876 in Bedford Co. PA19.  She married Jacob PENNELL; born 10 Jan 181020,21; died 2 Dec 1878 in Bedford Co. PA22.

The last Will and Testament of Thomas Jay of Southampton Township, Bedford County, State of Pennyslvania. I, Thomas Jay considering the uncertainty of this mortal life and being of sound mind & memory blessed be Almighty God for the same do make & publish this my last Will & Testament in manner & form following that is to say 1st I will that all my just debts as shall be by me owing at my death together with my funeral expenses and charges touching the proving of or otherwise concerning this my last will shall in the first place out of my estate and effects be fully paid and satisfied 2@ I give all that I have at my death both personal and Real estate to my beloved wife Elizabeth Jay to have and to hold as long as she may remain my lawful widow or give away any of my effects unless she shall be wanting for her own use, 3@ I will and bequeath to all my children one equal share, share and share alike after the mariage of my wife or if she does not marry after her death, To my daughter Elizabeth intermarried with James Pennell one share, To my daughter Nancy intermarried with Joh Pennell one share, To my son Samuel Jay one share To my daughter Christena intermarried with William Smith one share To my daughter Rosella intermarried with Jacob Pennell one share, To my daughter Eliza intermarried with Abner Tewell one chare, To my daughter, Catharine intermarried with Isaiah Hill one share, and my will is that Isaiah Hill one share is not to get any of my daugter Catharine's share, To my daughter Mary Jay single woman one share, and my will is that my Executor shall chuse two men and praise [appraise?] my personal property and then give lawful notice by advertisements on a set day & sell the same to the highest or best bidder, and their proceeds on and sell my Real estate without any appraisement but first give lawful notice by printed or written advertisements to the highest or best bidder giving it in such payments as my Executor may think my Real estate will sell best, and lastly I hereby appoint John Pennell Sole Executor of this my last Will and Testament hereby revoking all former made by me, In witness whereof I have hereunto set my hand and Seal this 25th Day of May in the year of our Lord one thousand eight hundred & fifty

Housare two of the subscribing witnesses to the foregoing investment of writing who being duly sworn according to Law do depose & say that they were present & saw the Testator sign his name to the same & he and him pronounce & declare the same to be his last Will & Testament that he desired them to sign their names as witnesses to the same & at the time also doing he the said Testator was of sound & disposing mind memory & understanding to the best of their knowledge & belief
